myPCgeek Terms and Conditions

1. Service Area Coverage and Availability
myPCgeek generally provides on-site service coverage in the Orange County area and may include other towns and/or cities than those listed. myPCgeek, however, makes no guarantee as to the availability of service coverage at any particular location. Local pick-up and delivery will be provided for the Orange County Area, but myPCgeek has the right to change this policy at any given time, without prior notice.

2. Business Hours and Availability of Services
myPCgeek provides services in the Orange County area within the hours of 8am to 6pm Monday through Friday, afterhours and weekends by appointment only. myPCgeek, however, reserves the rights to amend these hours, without prior notice. myPCgeek does not make any guarantee as to the time frame of services provided, unless expressed directly in a written contract between myPCgeek and the party to which such services shall be provided. Availability of services may depend upon the availability of services and parts. myPCgeek shall not be held liable for delays in its own products or services caused by shortages or delays from any such third party, although reasonable efforts shall be made to ensure the efficient delivery of products and services.

3. Service Fees and Payment
myPCgeek On-Site service will diagnose and service your computer for a fee of $90 for the first 2 hours of repairs and each additional hour billed in 30 minute increments. myPCgeek Remote and Online services will diagnose and service your computer for a fee of $90 an hour for the first 2 hours (billed in 30 minute increments) and additional time billed in 15 minute increments. myPCgeek, however, reserves the right to change these rates at any point in time, without prior notice, unless previously expressed directly in a written contract between myPCgeek and the party to which such fees will be charged. Once service is complete, the party’s payment for actual costs incurred and the final sum owed is due. Should it be determined in the course of the performance of diagnostics that the problems on the customer’s computer are far more complicated or time consuming than initially estimated by myPCgeek, we will notify the party and inquire as to what course they would like to take from there on out. myPCgeek however will try to perform all necessary services to properly complete the diagnosis of a computer if this situation were to occur.

4. Warranty and Liability
In servicing your computer, myPCgeek warrants that service will be performed in a professional and timely manner. All services are warranted for a period of 14 days at the discretion of myPCgeek. There is NO warranty for removal of viruses, spyware, adware, or malware; if they are the cause of a repeat effort, the customer will be charged again for service. Unless otherwise agreed, myPCgeek is not liable for any and all damages, costs, and expenses incurred as a result of any defect or damage to any software or data residing or recorded in the party’s computer, whether incurred during the course of services or otherwise. If service involves transferring information or installing software, the customer has the legal right to copy the information, to use the software and agree to the terms of the software license, and the party authorizes myPCgeek to transfer the information and accept such terms on your behalf in performing the service.

5. Installation Authorization
For on-site services, a person at least 18 years of age must be present during the entire time period services are provided. If no adult is present when the myPCgeek tech arrives, services will be denied and a $40 cancellation charge will be assessed.

6. Responsibility
It is your responsibility to back up all software and data on your computer's hard drive(s) and/or any other storage devices before the myPCgeek tech works on your computer. myPCgeek shall not be responsible at any time for any loss, alteration, or corruption of any software, data, or files.

IMPORTANT:
IF ANY DAMAGE SHOULD OCCUR WHILE THE COMPUTER OR SYSTEMS ARE BEING SERVICED, myPCgeek HAS NO LIABILITY FOR THE COST OF REPAIR OF THE AFFECTED COMPUTER. myPCgeek ENTIRE LIABILITY TO THE CUSTOMER FOR DAMAGES ARISING FROM ANY CAUSE WHATSOEVER, WITH RESPECT TO THE SERVICE OF THE COMPUTER, IS LIMITED TO THE AMOUNTS THAT YOU PAY myPCgeek FOR SUCH SERVICE. myPCgeek HAS NO LIABILITY WHATSOEVER FOR INDIRECT, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF USE, LOST PROFITS OR REVENUE, OR ANY OTHER DAMAGES NOT OTHERWISE EXPRESSLY PERMITTED UNDER THIS AGREEMENT. myPCgeek ALSO HAS NO LIABILITY FOR LOSS OF OR DAMAGE TO DATA OR SOFTWARE APPLICATIONS WHILE PERFORMING SERVICE. IT IS THE CUSTOMERS RESPONSIBILITY TO MAINTAIN COPIES OF ALL IMPORTANT INFORMATION ON THEIR COMPUTER PRIOR TO AUTHORIZING myPCgeek TO COMMENCE ITS SERVICES.
